Separation
Separating from your partner can be one of the most difficult and painful experiences of your life. Emotions can run high as you attempt to adapt to your new circumstances. You can count on our lawyers to guide you through the process of your separation.
‘Separation’ is traditionally defined by the law as ‘the breakdown of the marital relationship’. Regardless of whether you or your spouse has made the decision to separate, there are three conditions that must be met:
- The intention to separate; and
- Acting on that intention; and
- Communication of the intention to separate.
The first thing you should do is speak with a family lawyer to ensure the process goes as smoothly as possible. Our lawyers will provide helpful and caring advice at all stages and will endeavour to keep you out of court. We will even help refer you to any counselling services you may require.
